These terms govern the use of Banners City. They form an agreement between the operator of the site — the company named on the Contact page — and everyone who buys an advertising spot or visits the site. By submitting a request for a spot, paying for it or creating an account you accept these terms.
What Banners City is
Banners City sells advertising spots on a grid. Every location — country, city, district — has its own grid of square cells, and an advertiser buys a rectangle of cells and puts a banner in it. The banner links to the advertiser’s own site.
The entire content of this site is advertising submitted by advertisers. We provide the space and the tools; we do not write the banners, we do not run the businesses behind them and we do not verify the goods, services, offers or claims they advertise. A banner appearing on the site is not a recommendation, an endorsement or a guarantee by us.
Buying a spot
You select free cells in the grid, submit a request and pay. Spots are sold as a solid rectangle of an allowed size. The price depends on the location, the number of cells and the row: the higher the row, the more expensive the cell. The price shown at the moment of purchase is the price you pay, and it does not change while that placement is active.
You can pay for a spot monthly, pay a year ahead at the price of ten months, or buy the spot out for a fixed long term stated at the moment of purchase. Card details never reach our servers. Prices are shown in the currency of the location; any tax that applies to you is calculated and shown at checkout before you pay.
Who sells you the spot
Card payments are handled by Dodo Payments, our online reseller and merchant of record. That means Dodo Payments is the seller of record for the transaction: it takes the payment, calculates and remits any sales tax, VAT or GST due on it, issues the receipt and handles payment disputes. On your card or bank statement the charge appears as Dodo Payments, not as Banners City. The advertising service itself is provided by us, and everything in these terms about the spot, moderation and support applies between you and us. Where PayPal is offered as an alternative, the payment is taken by us directly and PayPal only processes it.
A spot is reserved for you when the request is created and goes live after the banner passes moderation. A monthly subscription is a year of placement paid in twelve monthly charges, and its price is fixed for that year. If a renewal is not paid, the placement stays visible for 7 more days and the spot is then released and offered for sale again.
Your content is your responsibility
You are solely responsible for everything you publish through Banners City: the image or the video, the text on it, the link, the site the link leads to and the goods or services offered there. This works the way it works on a social network — we host what you publish, you answer for it.
By submitting a banner you confirm that:
- you own the rights to every part of it — images, video, text, fonts, music, logos — or hold a licence that allows this use, and publishing it infringes no one’s copyright, trademark, design, personality or privacy rights;
- the banner and the destination site are lawful where they will be seen, and you hold every licence, permit or registration that the advertised activity requires;
- nothing in the banner or on the destination site is false, misleading or designed to deceive a visitor;
- the banner follows the Content and advertising policy and the Copyright and trademark policy, which are part of these terms;
- you will keep the destination link working and pointing to what the banner promises for as long as the placement is live.
Any transaction between a visitor and an advertiser happens between those two. We are not a party to it, we do not process it and we are not responsible for its outcome.
Moderation
Every banner is reviewed before it is published. The review is a basic check against our rules, not a verification of the advertiser or of the claims made: passing it does not make us responsible for the content and does not mean we vouch for it.
We may refuse, pause or remove a banner at any time, before or after publication and without prior notice, if it breaks these terms or the Content and advertising policy, if it looks fraudulent, deceptive or unsafe, if the destination changes into something that would not have passed review, or if a court, a regulator or a rights owner requires it. Repeated or serious violations lead to suspension or closure of the account.
Money follows the reason for removal. A placement removed because it broke the rules is not refunded. A placement removed by our mistake is restored or refunded for the unused period — see the Refund and cancellation policy.
The service is provided as it is
We work to keep the site available and the grid running, but we do not promise uninterrupted access, a particular number of visitors, impressions, clicks or sales, or that a placement will produce any result at all. The statistics shown in the account are our own measurements and are given for information.
We may change the design of the site, the size of the grid, the way locations are organised and the tools in the account. We will not shrink a placement you have already paid for or move it to another location without your agreement.
Liability
To the fullest extent allowed by law, our liability to an advertiser is limited to the amount that advertiser paid for the affected placement during the twelve months before the event. We are not liable for lost profit, lost business, lost data or other indirect losses.
You agree to cover our losses, including reasonable legal costs, if a third party brings a claim against us because of a banner you published, a link you set, a right you did not hold or a law you did not follow.
Accounts
You are responsible for what happens in your account and for keeping access to your mailbox secure — sign-in codes are sent there. Tell us at once if you think someone else has access. You may close your account at any time; closing it releases the spots bound to it, and paid periods that are still running are handled under the Refund and cancellation policy.
Changes to these terms
We may update these terms. The current version is always on this page. Changes apply to purchases made after they are published; if a change materially affects a placement you have already paid for, you may cancel that placement and receive a refund for the unused full months.
Law and disputes
These terms are governed by the law of the country in which the operator is registered, as stated on the Contact page, and disputes are heard by the courts of that country — unless the consumer law of your own country says otherwise. Before going to court, write to us: most disputes are settled by email in a few days.
